The following Terms and Conditions have been prepared to help you make the most of Hot Space Yoga Ltd t/a The Yoga Lighthouse. Please take a few moments to read them thoroughly.
1. INTERPRETATION AND VARIATION
1.1 In the Terms and Conditions the following definitions apply:
“Member” “you” means any person that has completed and submitted the health questionnaire at Hot Space Yoga Ltd t/a The Yoga Lighthouse and whose registration has been accepted by Hot Space Yoga Ltd t/a The Yoga Lighthouse
“Studio” means The Pump House, 3 Broadmeads Pumping Station, Hertford Road, Ware SG12 9LH and/or Modern House, Sucklings Yard, Church Street, Ware SG12 9EN.
“Terms and Conditions” means these terms and conditions.
“Website” means www.theyogalighthouse.co.uk
1.2 References in the Terms and Conditions to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine gender.
1.3 The Terms and Conditions are incorporated into and form part of the health questionnaire.
1.4 Hot Space Yoga Ltd t/a The Yoga Lighthouse reserves the right to vary and revoke the Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of the affairs of the Studio and the conduct of Members. Any such changes will be notified to Members and, until revoked, are and will be binding for Members.
1.5 The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.
2.1 Subject to condition 2.2, when a person has completed the health questionnaire they become a Member of the Studio.
2.2 Acceptance of a person as a Member is at the absolute discretion of Hot Space Yoga Ltd t/a The Yoga Lighthouse.
2.3 Hot Space Yoga Ltd t/a The Yoga Lighthouse reserves the right to expel from the Studio, suspend for a specific period or refuse to renew the membership of, any Member whose conduct is or may, in Hot Space Yoga Ltd t/a The Yoga Lighthouse’s reasonable opinion, be injurious to the character of the Studio, or which amounts to a breach of the Terms and Conditions, or where such expulsion is otherwise in the interests of the other Members of the Studio. Any Members so expelled will forthwith cease to be Members of the Studio and will not be entitled to any refund for any period during which the membership is suspended.
3. BOOKING AND CANCELLATION OF CLASSES
3.1 A Member may only book, reschedule or cancel sessions via their personal Studio booking facility on the website or by telephoning or emailing the Studio.
3.2 Sessions are booked on a first-come first-served basis. A member may pre-book classes up to 3 months in advance. A Member may use the waiting list facility on the Website in the event that his first choice session is unavailable. If a Member joins the waiting list for a particular session and then books that session his booking will be subject to the Terms and Conditions in the usual way.
3.3 Out of consideration for the instructor and other Members, and for your own safety please arrive at least 5 minutes early in preparation for the class, the warm-up is an important aspect of each class. Please be aware that other classes may be taking place so please wait in the designated area quietly.
3.4 If you are more than 5 minutes late for a class you will not be able to take part. In this instance Hot Space Yoga Ltd t/a The Yoga Lighthouse reserves the right to charge you for the session. If you arrive late within the first 5 minutes enter the class quietly showing consideration towards other Members.
3.5 If you arrive late it is your responsibility to notify the instructor of any injury or health issues.
3.6 Members can cancel to reschedule sessions up to 4 times in any 12 month period for a holiday but must give the Studio at least 24 hours notice. Failure to cancel a session within 24 hours of its start time will result in the Member being charged for the session and foregoing their right to reschedule. Rescheduled sessions will be taken in addition to the regular classes attended and must be taken within 6 weeks of the return date of your holiday.
3.7 Where a Member is unable to attend classes due to circumstances outside of his control, at the absolute discretion of the Studio, up to 2 emergency classes can be requested per. These are valid for 2 weeks from the date of request. The request must be made prior to the class starting or within 24 hours.
3.8 Members can cancel to reschedule sessions for that same week but must give the Studio 24 hours notice by email or preferably use the booking system to cancel where 8 hours notice is required. You will then be given a credit which can be used to reschedule a different class, subject to availability. Please note members who opt for a weekly allowance the week runs Monday to Sunday and then restarts so all credits need to be used by the Sunday. Any unused classes cannot be carried forward or refunded.
3.9 You can choose whether to opt for a weekly or monthly allowance. The weekly allowance gives you slightly more classes a year but the monthly allowance is more flexible. For example the weekly allowance on one class a week would give you 50 classes a year (we are open 50 weeks of the year) but a monthly allowance would be 4 classes a month so would give you 48 classes a year.
4. STUDIO OPENING TIMES
4.1 Details of session times at Hot Space Yoga Ltd t/a The Yoga Lighthouse may vary from time to time, including cancellations of individual classes. Class times will be published by the Studio and will be available either at the Studio or on the Website
4.2 Class size is limited, therefore attendance is on a first come, first served basis. All attendance must be pre-booked and paid for where applicable.
4.3 The studio will be closed for a maximum of 2 weeks over the Xmas period. Prices have been calculated to take this into consideration i.e. fees are based on a 50 week year so you will still be required to pay the full price in December and no credits or refunds are applicable.
5. PAYMENT TERMS
5.1 Details of class prices and Memberships are available directly from the Studio and will be such prices as determined by Hot Space Yoga Ltd t/a The Yoga Lighthouse from time to time.
5.2 Before attending a session at Hot Space Yoga Ltd t/a The Yoga Lighthouse each Member must pay for the session in full, where applicable, book themselves into a session and, prior to their first session at the Studio, complete the waivers and health questionnaire. If for any reason, you are unable to do this on-line, in advance of your session, please arrange with the Studio to arrive early to complete this in advance.
5.3 Subject to any statutory right of cancellation, payments for classes, monthly subscription fees and annual payments are non-refundable and non-transferable unless otherwise stated in the Terms and Conditions.
5.4 The ‘Complimentary Free classes’, are available to book via the Website or at the Studio, and shall only be available to clients for their first sessions at the Studio. It will be at the discretion of Hot Space Yoga Ltd t/a The Yoga Lighthouse if any further complimentary classes are granted.
5.5 If you are receiving a loyalty discount if you default on your payment (subject to 6.2) or cancel your payment or membership you lose the privilege of this discount and will be charged the standard rate for all future payments (subject to 6.2).
6. RECURRING PAYMENTS BY DEBIT/CREDIT CARD INCLUDING CANCELLATION OF SUBSCRIPTION
6.1 The provisions of this clause 6 shall only apply to Members that subscribe to Hot Space Yoga Ltd t/a The Yoga Lighthouse classes by monthly recurring debit card payment (“Subscription”) or pay 6 or 12 months in advance by these payment methods.
6.2 Any Member, who is purchasing classes by Subscription, will forfeit their membership if they fall behind in payment for more than 10 working days.
6.3 A Member, who is purchasing classes by Subscription, may at the discretion of Hot Space Yoga Ltd t/a The Yoga Lighthouse, and under exceptional circumstances as deemed by Hot Space Yoga Ltd t/a The Yoga Lighthouse, suspend their membership for a period of not less than 1 month, and up to three months in any 12 month period, two months in any 6 month period and one month in any 3 month period. However, your place on a class cannot be reserved or guaranteed when you return.
6.4 Subscription fees must be paid in accordance with the Terms and Conditions irrespective of whether or not the Member uses the Studio‘s facilities.
6.5 Members shall be given not less than 10 working days written notice of any increase in their Subscription.
6.6 Members purchasing classes by Subscription will be allocated access to the number of classes per week or month based on the monthly programme they choose and subscribe to as detailed on the website.
6.7 Monthly rolling payments will automatically roll over at end of each month. The cancellation notice required will depend on the programme chosen. We offer 3, 6 and 12 month programmes which are monthly rolling payments which will automatically roll over at the end of each programme for the same period. It is the responsibility of the client to advise Hot Space Yoga Ltd t/a The Yoga Lighthouse in writing should they wish to cancel or change their contract, at least 10 days in advance of the last payment date (or 10 days in advance of the expiry of the programme if paid for in advance).
6.8 To give notice of cancellation of a Subscription a Member must complete a cancellation form, which is available from the Studio or send an email entitled Cancellation of Membership and specifically state they wish to cancel their membership giving the required notice period. The notice period will begin when the completed cancellation form or email has been received by Hot Space Yoga Ltd t/a The Yoga Lighthouse. Non-attendance of classes or non-booking of classes does not constitute notice of cancellation.
If you cancel a recurring card payment without the required notice period or before the contract finishes (for example before the end of the 3, 6 or 12 month contract you have agreed to) you will be sent a separate bill and will be required to pay any outstanding balance in full subject to the programme and cancellation notice period you have agreed to.
6.9 Where you pay by subscription you are entitled to book your classes 3 months in advance. It is your responsibility to ensure your class is booked in advance to guarantee your place, subject to availability. If availability is showing this means that another Member may book that place.
Refunds and Cancellation of Classes Policy
6.10 Cancellations of bookings are accepted up to 8 hours in advance, if cancelled on the on-line booking system by the Member and substitute sessions may be booked (subject to availability) during the same week if a weekly allowance has been chosen. A week runs Monday to Sunday. Alternatively you can opt for a monthly allowance. If a Member is unable to cancel on the on line booking system 24 hours notice by email notification is required. No refunds are offered for classes that cannot be attended.
6.11 Cancellations with less than 8 hours notice are forfeited. If you are unable to attend a session due to unforeseen circumstances Hot Space Yoga Ltd t/a The Yoga Lighthouse will determine on a case by case basis if an alternative class may be attended. This will be considered up to a maximum of 2 times in every 12 month. Cancellations must be made through the online booking system wherever possible.
6.12 If a class needs to be cancelled by Hot Space Yoga Ltd t/a The Yoga Lighthouse due to circumstances beyond its control e.g. Unsafe road conditions, travel conditions, adverse weather, no refunds are payable. An alternative class booking will be offered.
6.13 If a class needs to be cancelled on an ad hoc basis by Hot Space Yoga Ltd t/a The Yoga Lighthouse due to low numbers or no teacher being available, an alternative booking will be offered in the first instance. If this is not an option for the Member then consideration will be given to refund a single class, based on the membership price paid by the Member.
6.14 Monthly prices are based on 50 classes per year to allow for a maximum 2 week closure at Xmas.
7. CONDITIONAL MONEY BACK GUARANTEE
Money back guarantee (for the first 2 months of a 3, 6 and 12 month Empower, Improve and Transform Programme)
7.1 If at the end of the first month you can honestly say you followed all of the requirements and do not look or feel better than you did before you began the programme we will refund your entire 1 month programme investment. Providing you have attended all sessions and followed all recommendations, you will be entitled to a full refund. The minimum requirement from you is
i. Attend the minimum number of classes on the recommended programme for a minimum of 1 month and follow the instructions given by your Instructor
ii. Follow any additional instruction given to enhance your programme.
7.2 No requests for refund will be considered until the end of the first 1 month, nor where sessions have been missed (unless pre-agreed holiday allowance has been taken and the 1 month period extended by the period of the holiday).
7.3 Requests for refunds must be made in writing to Hot Space Yoga Ltd t/a The Yoga Lighthouse within 7 days of completion of the first 1 month of classes, giving the reason for not being entirely satisfied and providing the terms and conditions have been met as stated above you will receive your refund within 30 working days. We reserve the right to discuss this with you to ensure we obtain feedback to help us improve our services.
8. FITNESS AND HEALTH
8.1 Members are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. Hot Space Yoga Ltd t/a The Yoga Lighthouse reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of its facilities.
8.2 Members are required to follow the instructions of the instructor at all times.
8.3 Members are required to inform a member of staff, if they incur injuries or conditions, or become pregnant after the initial information stated on their health questionnaire.
9. USE OF FACILITIES
9.1 A Member is entitled to use the Studio’s facilities, during normal operating hours as detailed on the timetable, provided always that the Studio may at any time without notice withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work, or for reasons beyond the control of Hot Space Yoga Ltd t/a The Yoga Lighthouse.
9.2 Children under the age of 16 are unable to attend Adult classes at the Studio. 16-18 year olds can attend classes unaccompanied but authority forms will be required to be completed by a parent or guardian.
10. SAFETY AND HYGIENE
10.1 In the interests of safety and hygiene, no crockery or glass are permitted in the Studio. Only water is permitted to be taken into the studio in a sealed bottle. No pets (with the exception of guide dogs), are permitted in the Studio. Before Members enter the class they are required to remove their shoes and leave them in the designated area outside the studio. However, Members must not walk around the Studio barefoot if they have verrucas or similar foot complaints. Please wear socks or indoor flip-flops.
10.2 Members must use the main entrance to the Studio when entering or leaving the Studio. Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with these exits for any reason.
10.3 In the event of a fire, Members are asked to make their way to the nearest available fire exit.
10.4 Smoking is forbidden in the Studio.
11. PERSONAL BELONGINGS
11.1 Personal belongings are brought onto the Studio premises at the Member’s own risk and Hot Space Yoga Ltd t/a The Yoga Lighthouse does not accept liability for any loss or damage whatsoever to such items. Personal belongings are not to be left on the studio floor or reception area, there is a designated area within the studio where Members may leave their belongings.
11.2 All mobile phones should be switched to silence once you have entered the Studio.
11.3 Parking is available on site in the yard after 6pm and at weekends on a first come first serve basis. At no other time are you authorised to park in the yard outside of these times. At all other times you will need to find alternative parking arrangements. Breach of these terms and conditions on parking times will not be tolerated. If you park here you also run the risk of having your car removed or clamped . Vehicles parked on the premises or any alternative locations are parked at the Member’s own risk and the Studio accepts no liability for any loss or damage whatsoever to such vehicle.
12. LIMITATION OF LIABILITY
12.1 Hot Space Yoga Ltd t/a The Yoga Lighthouse cannot be held responsible for any particular session, instructor and/or item of equipment not being available for whatever reason. Hot Space Yoga Ltd t/a The Yoga Lighthouse reserves the right to make alterations to the sessions, instructors and/or equipment, as well as to the ancillary facilities provided to Members, without notice and in its absolute discretion and Hot Space Yoga Ltd t/a The Yoga Lighthouse will not be liable for any loss occasioned by such alterations except insofar as such loss is by law incapable of exclusion.
12.2 It is the Member’s responsibility to ensure that he is capable of undergoing a routine of exercises provided by any programme which he follows or session which he attends. Members accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by instructors at Hot Space Yoga Ltd t/a The Yoga Lighthouse at no time constitutes medical advice in substitute for advice provided by a medical professional
12.3 Hot Space Yoga Ltd t/a The Yoga Lighthouse accepts no liability for loss or damage to property of Members or for injury to Members on the Studio premises or outside the Studio except insofar as such loss, damage or injury is by law incapable of exclusion.
12.4 In consideration of their participation in the activities and programmes of Hot Space Yoga Ltd t/a The Yoga Lighthouse and the use of facilities and equipment owned and/or under the control of Hot Space Yoga Ltd t/a The Yoga Lighthouse the Member hereby waives and releases Hot Space Yoga Ltd t/a The Yoga Lighthouse and its instructors from any and all responsibility or liability for injuries or damages resulting from their participation in any of Hot Space Yoga Ltd t/a The Yoga Lighthouse activities or use of Hot Space Yoga Ltd t/a The Yoga Lighthouse equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of Hot Space Yoga Ltd t/a The Yoga Lighthouse.
13.1 Members are required to give notice to Hot Space Yoga Ltd t/a The Yoga Lighthouse of any change of home address, email address and telephone number. Failing such notice, all communications will be assumed to have been received by the Member within five days of mailing to the last address (of either type) notified to Hot Space Yoga Ltd t/a The Yoga Lighthouse
13.2 Hot Space Yoga Ltd t/a The Yoga Lighthouse reserves the right to refuse admission to the Studio.
13.3 Hot Space Yoga Ltd t/a The Yoga Lighthouse may, if a Member so wishes, communicate with the Member by electronic mail (“email”). By providing an email address to Hot Space Yoga Ltd t/a The Yoga Lighthouse, the Member consents to receiving email communications from Hot Space Yoga Ltd t/a The Yoga Lighthouse, including notices pursuant to the Terms and Conditions. The Member also accepts the risk that email may not be a secure and confidential means of communication. Hot Space Yoga Ltd t/a The Yoga Lighthouse will not be liable for any loss or damage suffered as a result of communicating with a Member by email.
13.4 Any marketing, educational or other materials of this nature whatsoever produced by Hot Space Yoga Ltd t/a The Yoga Lighthouse in connection with the Studio and which are made available to Members at the Studio, will at all times remain the property of Hot Space Yoga Ltd t/a The Yoga Lighthouse and will be subject to Hot Space Yoga Ltd t/a The Yoga Lighthouse copyright.
14. COMPANY INFORMATION
14.1 Hot Space Yoga Ltd t/a The Yoga Lighthouse a Company incorporated in England and Wales with registered no 10669683 whose registered office is at Modern House, Sucklings Yard, Church Street, Ware SG12 9EN.
